Terms and Conditions of HOPE PAY - .

  • Please read these terms and conditions carefully before using this MOBILE APPLICATION and its contents. Your use of this MOBILE APPLICATION is solely based on your acceptance of the terms and conditions contained herein. By using this Mobile Application you accept and accept these terms and conditions. If you do not agree to these terms and conditions, you must not use this MOBILE APPLICATION. HOPE PAY reserves the right to change these terms and conditions from time to time at its sole discretion.
  • It is specifically agreed that the HOPE PAY is an independent business entity and shall not be deemed to be any agent other than the transaction/services of the HOPE PAY and other related services mentioned above, which gives rise to the principal-agent is the relation by implication.
  • Neither HOPE PAY nor its employees, agents, representatives shall represent or represent themselves as agents
Activities And Skills
  • Neither the HOPE PAY nor its employees, representatives or agents of the HOPE PAY shall be entitled to permanent absorption or any other claim or claim of benefits at any time.
  • At no time, the HOPE PAY or its agents, representatives, shall claim employment of any kind
  • The amount paid to the HOPE PAY Franchisee is non-refundable.
  • One Time Charge will be governed by the marketing plan for the users in force from time to time. All such payments shall be non-refundable service payments for franchise fees, software solutions, training and administrative expenses. The specific terms of engagement will be governed by the current plan existing at the time of signing of the Agreement. The offer letter of the same shall become part of this agreement, which shall be abide by the parties. Fees and commission will be paid to the HOPE PAY subject to deduction of income wherever required under the provisions of the Income Act. The rates of services and commission will be part of the "Rates for Services" and will be available to the HOPE PAY Partners on the APP Portal. Rates and commission structure will change depending on market conditions. Rates applicable on any product will be known to HOPE PAY Partners via email / App page update.
  • One Time Charge will be governed by the marketing plan for the users in force from time to time. All such payments shall be non-refundable service payments for franchise fees, software solutions, training and administrative expenses. The specific terms of engagement will be governed by the current plan existing at the time of signing of the Agreement.   • Payment of fees/commission will be based on the centralized data of HOPE PAY and will be final and binding on weekly basis from HOPE PAY to HOPE PAY.

Term & Termination

• Terms and Termination of HOPE PAY -

  • HOPE PAY shall have the right to terminate the Agreement by giving three months notice in writing to the other party. In the event of termination of the Agreement by the HOPE PAY , all records, documents including information shall be returned to the HOPE PAY in accordance with the instructions of the. HOPE PAY shall have the right to terminate the Agreement immediately by giving a notice in writing in the following events:
  • It is specifically agreed that the HOPE PAY is an independent business entity and shall not be deemed to be any agent other than the transaction/services of the HOPE PAY and other related services mentioned above, which gives rise to the principal-agent is the relation by implication. If any receiver/liquidator is appointed in respect of the business of HOPE PAY with substantial assets in favor of its creditors or any order/direction is issued by any authority/regulator, which has the effect of suspension of business HOPE PAY
  • Files a petition for winding up or dissolution of HOPE PAY if the HOPE PAY applies to the Court or passes a resolution for voluntary declaration as an insolvent person or business entity or any other creditor/person .
Activities And Skills
  • If HOPE PAY is, in the proper opinion, unable to pay its debts or discharge its liabilities in the ordinary course of business.
  • If the HOPE PAY is unable to provide the Services envisaged under this Agreement, a proper assessment of the circumstances affecting the rendering of the Services by the HOPE PAY as envisaged under this Agreement shall be made.
  • If HOPE PAY or its agents, employees, representatives are representative of a reasonable opinion mechanism for fraud or prejudice to the interest of HOPE PAY or its customers, if due to commissions or omissions of any kind.
